Activeion Cleaning Solutions Limited Warranty
Activeion Cleaning Solutions LLC, 21308 John Milless Drive, Suite 104, Rogers, Minnesota 55374 (“Activeion”), warrants to the purchaser (“Purchaser”) that the Activeion Pro Sprayer will be free from defects in materials and workmanship and able to withstand normal use for a period of one (1) year from the date of purchase. To maintain this warranty, only fill the Activeion Pro Sprayer with tap water and follow all instructions in the manual.
If the Purchaser is dissatisfied with the Activeion Pro Sprayer within thirty (30) days of the date of purchase, Activeion will refund Purchaser’s purchase price upon return of the Activeion Pro Sprayer in essentially new condition with proof of purchase. If the Purchaser determines that the Activeion Pro Sprayer is defective within one (1) year of the date of purchase, Activeion will replace the Activeion Pro Sprayer at no charge to the Purchaser subject to Activeion’s receipt of notice in writing to the address set forth above describing the nature of the defect and return of the Activeion Pro Sprayer with proof of purchase. Upon receipt of written notice of defect, Activeion will provide Purchaser with instructions for prepaid return shipping.
This limited warranty shall not apply if product has been subjected to abuse, improper care or disassembled in any way or if the Activeion Pro Sprayer in question has not been afforded reasonable maintenance and care as described in the instruction manual. Any determination as to whether the claim is covered by this limited warranty will be made by Activeion, after consultation if appropriate with the Purchaser.
Except for the warranty set forth above, no representation or warranty made by any independent distributor, any sales or other representative of Activeion, or any other person concerning the product shall be binding upon Activeion.
THE REMEDIES PROVIDED TO THE PURCHASER HEREIN ARE THE EXCLUSIVE REMEDIES AVAILABLE UNDER THE LIMITED WARRANTY AND ARE INTENDED FOR THE SOLE BENEFIT OF THE PURCHASER. THE LIMITED WARRANTY SET FORTH HEREIN IS THE ONLY WARRANTY APPLICABLE TO THE PRODUCT AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, INFRINGEMENT OF PATENTS OR OTHER INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, ARE DISCLAIMED. IN NO EVENT SHALL ACTIVEION BE LIABLE IN CONTRACT, TORT OR OTHERWISE FOR ANY DIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES FOR, RESULTING FROM, OR IN CONNECTION WITH, THE USE, REPAIR OR PERFORMANCE OF THE ACTIVEION PRO SPRAYER OR BREACH OF ANY EXPRESS OR IMPLIED WARRANTIES.
The sole purpose of these remedies shall be to provide the Purchaser with the replacement of a non-conforming Product, or alternatively a refund of the purchase price if within the time period set forth herein, as provided in this limited warranty. These exclusive remedies shall not be deemed to have failed of their essential purpose as long as Activeion is willing and able to replace the non-conforming Product or refund the purchase price as provided herein.
